Its economy largely depends on the oil and gas extraction industries, concentrated in the southern part of the country, in a region known as the Zambezi Delta. The Zambino do not regard themselves as “indigenous peoples,” and neither the Government of Zambezia nor the international community characterizes as such. The Zambino and other inhabitants of the Zambezi Delta largely lead subsistence lives within the Delta, depending for the most part on hunting and fishing, and small-scale crop and livestock farming. However, successive governments since Zambezia’s independence from its erstwhile colonial power have pursued policies aimed at relocating some of the populations of the Delta to allow for more oil and gas exploration in an ever-increasing area. Only a few communities have left their original villages voluntarily. The majority have resisted and been removed against their will, in most cases following the wholesale destruction of their villages and farms. Two years ago, following a Cabinet decision, the Zambezia Government decided to start relocating more of the Delta communities more aggresively. It quickly emerged that this enhanced relocation policy was the result of an agreement reached secretly between the Government and Midlan Petroleum Company, a multinational corporation with headquarters in London, but registered locally in Zambezia. Under the agreement the Government of Zambezia has granted activities ten-fold. Midlan Petroleum works in collaboration with the Zambezia Power and Petroleum company (ZPPC), a state-owned corporation. Together they operate as the Oil and Gas Consortium (OGC or the Consortium). In fact, Midland Petroleum and OGC have been working together in the Delta for a number of years now. B. The Application before the African Commission on Human Peoples’ Rights: Zambezia Equal Rights Trust(ZERT), a leading Zambezia based NGO that specifically focuses on the rights of rural communities, has decided to lodge a complaint before African Commission on Human and Peoples’ Rights on behalf of the Zambino and other Delta communitites adversely affected by the enforced relocation policy and the oil and gas exploration activities of the OGC. The affected communities have mandated ZERT to represent them. In its communication that: 1. OGC has been exploiting the oil and as resources of the affected areas over a number of years with no regard to the health or environment of the Zambino communities, and that these extractive activities have led to the production of toxic waste with the consequent pollution of the rivers and streams running through the Delta. The OGC has also neglected and/or failed to maintain its facilities to prevent the spillage of toxic waste to several villages within the proximity of the industries. 2. The Zambezian Government has condoned and facilitated these violations by prohibiting any judicial review of its cabinet and other administrative decisions relating to the Government’s relocation policy and OGC’s oil and gas exploration and extraction activities. 3. Zambezian police and security forces have attacked and destroyed several villages in the Zambezi Delta with the objective of forcing the communities to relocate to the new designated settlements. In some cases, this enforced relocation has resulted in death of individuals and the separation of their families and loss of shelter and housing. Many of these communities have lost their means of livelihood due to their inability to continue hunting, fishing and farming. The Goverments’s silence suggests its complicity. C: The Government’s Response: 1. Zambezian Government denies all the allegations. It argues, that given the centrality of the oil and gas industry to the economic development of the country, its decisions should not be subject to judicial review and public scrutiny or challenge. It further argues that forcibly relocating communities from certain parts of the country is necessitate by the greater national objective of developing the country for the benefit of all Zambezians, and that this is consistent with the provisions of the African Charter on Human and Peoples’ Rights. 2. In particular, the Government insists that granting concessionary rights and licenses to the OGC for oil and gas extraction is consistent with the Zambezia’s duty under the African Charter of Human and Peoples’ Rights to ensure that collectively the Zambezian people enjoy the full exercise of the right to development. D. Relevant Human Rights Treaties/Instruments For the purposes of this examination question, you should assume that Zambezia is: (i) A member of the African Union (ii) A state party to the African Charter on Human and Peoples’ Rights; and (iii) A State party to the International Convention on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. E. Jurisdiction personae and locus standi before the African Commission on Human and Peoples’ Rights ZERT has observer status before the African Commission on Human and Peoples’ Rights and is entitled to submit complaints to it on behalf of individuals or groups of individuals in accordance with the African Commission’s Rules of Procedure(2010). F. The Question: You are an attorney hired by ZERT to prepare legal opinion identifying the specific rights in the African Charter on Human and Peoples’ Rights violated by the Government of Zambezia by its actions and collaborations with the OGC in its activities in the Delta.
