However, in Sajid’s contract with STL Operations (PLC) there was a clause which stated: ‘if you terminate your employment or your contract is terminated by your employer, you are prohibited from working from any competitor within a 50 mile radius’ Sajid continues to work for KFL Operations (PLC) and received a letter one day informing him that STL Operations (PLC) are suing him for breach of contract. Whilst at KFL Operations (PLC), Sajid has many arguments with the head manager, Kevin as Kevin feels Sajid is not performing and not meeting his sales targets. During one argument, Kevin says to Sajid: ‘I’m sick of you just pack your bags and get out’. Kevin has said this to Sajid on two separate occasions but on this occasion Sajid decides to pack his bags and leave employment with KFL Operations (PLC).
